State Employment of Probate Judges

Probate judges should be employed and funded by the State of Texas rather than by individual counties to ensure uniform, dedicated probate and guardianship services in every county without forcing smaller counties to delegate authority to non-specialist County Judges or share resources.

Note.

This resolution does not already exist as a Platform Plank in the 2024 Republican Party of Texas Platform. It is supported by Rule No. 4 (Adoption by Reference: Constitution of the United States and Constitution of the State of Texas), the Platform Preamble (protecting innocent life and developing responsible citizens through strong families), the Principles (Preservation of Constitution and Citizen Rights), the Constitutional Issues section (Preservation of Constitution and Citizen Rights), the Criminal and Civil Justice section (Family Law), and the Party’s stated mission to protect children and families.

County-based employment creates practical disparities that pervert equal access to justice in guardianship and estate matters affecting families, violating the Texas Constitution’s guarantees of equal protection and open courts while undermining the uniform application of laws that the Republican Party of Texas demands for all Texans.
