Statutory Prosecution and Treble Damages for Oath Violations (PRIORITIES)

Texas shall enact legislation creating a statutory mechanism that (1) authorizes the Texas Attorney General to independently prosecute, or appoint a special prosecutor for, any elected or appointed official, judge, attorney, or other person who has sworn an oath to uphold the United States or Texas Constitution and who violates that oath or commits a crime under color of office when local district attorneys refuse or fail to act, and (2) allows any injured citizen to recover treble damages, attorney’s fees, and court costs from such violators.

Note.

This enforces Article XVI, Section 1 of the Texas Constitution, the RPT Platform’s Dereliction of Duty plank and the Attorney General prosecution authority called for in the Preservation of Constitution section, plus Rule No. 4, while preventing officials from perverting the Preamble’s command to uphold constitutional supremacy and the Party’s mission to protect children and families from oath-breaking abuse in family law and custody proceedings. No such specific legislative priority currently exists in the 2024 RPT Platform.
